1. About KimoraPro and These Terms
KimoraPro is an independent software brand that develops and distributes
WordPress plugins and themes through
www.kimorapro.com.
These Terms of Service govern your use of the KimoraPro website, customer
account, products, and related commercial services. By purchasing or using
our products, you agree to be bound by these Terms.
(“KimoraPro”, “we”, “us”, or “our”). We develop and
distribute WordPress plugins and themes through
www.kimorapro.com.
These Terms of Service govern your use of our website, customer account,
products, and related commercial services. By accepting these Terms when
creating an account or placing an order, you agree to be bound by them.
You must have the legal capacity to enter into this agreement. If you act
for a business or another organization, you confirm that you are authorized
to accept these Terms on its behalf.
Please read these Terms together with the product information presented
before purchase, our Refund Policy, and our
Privacy Policy. Software components may also
be governed by the licenses supplied with them, as explained below.
2. Our Products
Our products include Hotel Booking Free, Hotel Booking Pro, and separately
available WordPress themes. These are digital software products. Unless
expressly included in an offer, a purchase does not include hosting,
domain registration, website setup, custom development, content entry,
or subscriptions to third-party services.
Hotel Booking Pro requires Hotel Booking Free. A theme purchase does not
include a Hotel Booking Pro license, and a Hotel Booking Pro purchase does
not include a paid theme, unless a bundle expressly states otherwise.
Features identified as Pro-only require the corresponding Pro product
and its applicable activation requirements.
KimoraPro supplies software, not accommodation or hotel management services.
We are not a party to reservations or payments between a hotel and its guests.
Refunds for our software are separate from a hotel’s booking cancellation
and refund policies.
3. Orders, Prices, and Paddle Payments
The product, website allowance, license term, currency, taxes, and total
payable amount are presented before you confirm your order. Prices marked
as tax-inclusive include the applicable taxes in that displayed price.
Your bank or payment provider may apply its own currency conversion charges.
Promotional pricing applies only on the terms stated in the offer.
For orders completed through Paddle, Paddle acts as the merchant of record
and authorized reseller. The relevant Paddle entity is the seller for the
payment transaction; KimoraPro remains the product supplier. Paddle handles
the transaction, applicable transaction taxes, and payment-related billing
processes. Your receipt identifies the Paddle seller for your order.
Paddle purchases are also subject to the
Paddle Buyer Terms.
Those terms govern your transaction relationship with Paddle; these Terms
govern your product and service relationship with KimoraPro. Nothing here
restricts rights granted to you by Paddle or by mandatory law.
4. Digital Delivery
After successful payment and any necessary order verification, we provide
access to the purchased files and applicable license information through
your customer account and/or order email. No physical goods are shipped.
Please supply an accurate email address and contact us if delivery is missing
or inaccessible. We will investigate and provide the purchased access or an
appropriate remedy, including a refund where required.
5. Website Allowances and Activation
Paid licenses are available for 1, 5, or 25 websites, as selected at checkout.
This allowance applies to the purchased product’s commercial activations
and associated services, not to the number of themes in our collection.
A 25-website license for one theme does not include 25 different themes.
Each separately operated production website counts toward the allowance.
Exceptions for development, staging, or multisite installations apply only
where expressly stated in the product’s published licensing information.
Contact us before purchase if your installation arrangement is unclear.
A license key is specific to its product. Theme and Hotel Booking Pro keys
are separate and are not interchangeable. Paid themes require successful
activation of the correct theme license before the paid frontend is enabled.
Activation and license-related services may require communication with our
licensing server. Keep your account credentials and license keys secure.
These website allowances concern KimoraPro’s commercial entitlements. They
do not override permissions granted by an applicable open-source license.
6. License Term, Updates, and Expiration
Unless a product offer states otherwise, a paid license includes 12 months
of access to product downloads, available updates, and standard product
support, beginning on the purchase date. Your order identifies the
applicable entitlement period. New products and separately sold add-ons
are not automatically included.
When that period expires without renewal, access to new downloads, updates,
and premium support ends. Expiration does not revoke rights already granted
under an applicable open-source software license.
For a KimoraPro theme that has been validly activated on the same website,
expiration of the update and download entitlement alone does not disable
that installed theme. This does not extend an expired entitlement to new
downloads, updates, support, or activation on additional websites.
We cannot promise that an older version will remain compatible with future
changes to WordPress, hosting environments, or third-party software.
7. Renewals and Subscription Cancellation
An annual license term does not by itself authorize automatic charges.
Where checkout expressly identifies an order as an automatically renewing
subscription, it renews at the disclosed interval until canceled. Otherwise,
extending your entitlement requires a separate renewal purchase.
For a Paddle subscription, you can cancel future renewals through the
subscription management link in your Paddle email or by contacting
Paddle buyer support. Cancellation normally
takes effect at the end of the paid billing period. Deactivating a license,
uninstalling a product, or no longer using a website does not cancel billing.
Cancellation stops future renewals; it does not automatically refund a
payment already made. Refund and statutory withdrawal rights remain
available where applicable. Renewal prices and any changes will be
disclosed before the relevant charge, with notice and consent where required.
8. Software Licenses and Intellectual Property
Components distributed under the GNU General Public License (GPL) or another
open-source license remain governed by that license. Nothing in these Terms
takes away rights to use, study, modify, or redistribute such components
where the applicable license permits those activities. If these Terms
conflict with an applicable open-source license, that license controls for
the affected component.
Purchasing commercial access does not transfer ownership of KimoraPro’s
trademarks, logos, website content, or other intellectual property. Rights
in third-party materials remain with their respective owners. Redistribution
of software does not include permission to share KimoraPro account access,
license keys, or access to our paid update and support services.
9. Support and Compatibility
During an active support period, standard support covers product installation
guidance, documented features, configuration questions, and investigation
of reproducible product defects. Unless separately agreed, it does not
include custom development, website administration, recovery of lost data,
or fixing defects entirely within third-party products or custom code.
Please review the published system requirements and compatibility information
before purchase. We do not guarantee compatibility with every plugin, theme,
hosting service, or future software release. This does not limit our
responsibility for compatibility we expressly advertised for your purchase.
Support is provided through our published support channels. We do not promise
a fixed response or resolution time unless expressly agreed. We may request
relevant diagnostic information, but you should not send payment credentials
or unnecessary guest data. Test changes on a staging site and keep backups.
10. Refunds and Consumer Rights
KimoraPro offers a conditional 14-day commercial refund policy. Submit your
request within 14 calendar days of the relevant purchase, including your
order reference and a description of the issue. Under this policy, a refund
is available when a reproducible defect or incompatibility attributable to
our product prevents it from performing materially as advertised and we
cannot resolve it within a reasonable time. A timely request remains timely
even if our investigation continues beyond the 14-day period.
Under this commercial policy, a change of mind, purchase of the wrong product,
a need for a feature that was never advertised, or an issue caused solely by
third-party software or your own modifications does not by itself qualify
for a refund. These conditions do not exclude refunds or other remedies
required by law or available under applicable Paddle terms.
Send requests to KimoraPro Support Center. For Paddle purchases, you may also use the
support link in your receipt or Paddle buyer
support. Approved refunds are processed through the original payment
provider, normally to the original payment method. Payment-provider and
bank processing times may vary. Our detailed
Refund Policy also applies.
Mandatory consumer remedies, statutory withdrawal rights, and any more
favorable rights applicable to your purchase remain unaffected. Downloading
a product does not, by itself, waive every refund right. Any legally permitted
waiver of a digital-content withdrawal right requires the applicable
checkout consent and other legal conditions. Paddle’s own
Refund Policy
applies to transactions it handles.
A completed refund ends the associated paid entitlements, including the
relevant license key, downloads, updates, and support. Rights in any
open-source components remain subject to their applicable licenses.
11. Your Website and Guest Responsibilities
You are responsible for operating and securing your website, maintaining
backups, selecting suitable hosting, and checking your configuration before
accepting live bookings. This includes room inventory, availability, prices,
taxes, payment settings, booking policies, and customer communications.
You are also responsible for the notices, permissions, and other legal
requirements applicable to your own business and your processing of guest
information. Our products do not constitute legal, tax, or regulatory advice.
You control your relationship with your guests, including booking disputes
and hotel refunds. These responsibilities do not exclude our liability for
defects or breaches for which we are legally responsible.
12. Third-Party Services and Demo Content
Integrations may require separate third-party accounts, approvals, fees, or
agreements. Those providers control their own services and may change their
functionality or availability. KimoraPro does not guarantee their uptime
or continued availability.
Demo websites illustrate possible configurations and may include Pro
features, sample content, or third-party assets not included in every
purchase. Your product description identifies what is included. Any supplied
third-party assets remain subject to their accompanying license terms.
13. Privacy
Our Privacy Policy explains how we process
information relating to our website, customers, support, and licensing
services. Paddle provides separate information about payment-related data
in its Privacy Notice.
You must not provide us with another person’s confidential or personal
information unless you have an appropriate basis to do so.
14. Misuse and Suspension
Do not use our website or commercial services for unlawful activity, payment
fraud, unauthorized account access, distribution of malicious code, or
interference with our systems. Do not publicly share license credentials
or obtain commercial services beyond your purchased entitlement.
We may proportionately restrict affected commercial services for a material
breach, substantiated abuse, or a genuine security threat. Where appropriate,
we will explain the reason and allow a reasonable opportunity to resolve it.
Urgent protective action may be taken without advance notice where necessary.
This does not override open-source rights or mandatory customer remedies.
Please contact us or Paddle about payment concerns. Doing so is encouraged,
not a prerequisite to exercising lawful payment-dispute rights. Raising a
genuine complaint or lawful chargeback is not, by itself, misuse.
15. Warranties and Liability
We will honor express commitments made for your purchase and obligations
imposed by applicable law. Subject to those commitments, we do not promise
uninterrupted or error-free operation, compatibility with every environment,
or any particular revenue, occupancy, search ranking, or business outcome.
For business customers, to the extent permitted by law, KimoraPro is not
liable for indirect or consequential business losses. Our aggregate
liability relating to an affected product is limited to the amount paid
for that product during the 12 months preceding the event giving rise to
the claim.
These limitations do not apply where prohibited by law, including liability
for fraud, fraudulent misrepresentation, or other non-excludable misconduct,
death or personal injury caused by negligence, and mandatory consumer
rights or remedies. They do not remove an otherwise applicable obligation
to provide a refund. Consumers retain all protections that cannot lawfully
be excluded or limited.
16. Changes to Products and These Terms
We may release updates, revise future offers, and update these Terms.
Changes will be identified by an updated date. Material changes affecting
an ongoing paid service will be communicated in advance where required.
We will not retroactively remove accrued rights or reduce the material
entitlements already purchased for a paid term without a lawful basis
and any required consent or remedy.
Future features and roadmap statements are not included commitments unless
expressly made part of your purchase. Please retain a copy of the terms
and product description applicable to your order.
17. Applicable Law and Disputes
These Terms between you and KimoraPro are governed by the laws of
[GOVERNING_JURISDICTION], subject to any mandatory protections applicable
where you live. Nothing in these Terms removes a consumer’s right to rely
on mandatory local law or bring a claim in a court available under that law.
Please contact us first so we can try to resolve a concern. This does not
prevent you from seeking any available legal remedy. Disputes concerning
your transaction relationship with Paddle are governed by the applicable
Paddle Buyer Terms, not by a different jurisdiction selected in this section.
If a provision is unenforceable, the remaining provisions continue to apply
to the extent permitted by law.
